Terms of Service

1. Agreement to these terms

These Terms of Service govern your access to and use of Popularity of the World, including its website, accounts, posts, videos, comments, rankings, memberships, gifts, and creator features (collectively, the “Service”).

The Service is operated by Seth W. English (“Popularity of the World,” “we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms and our Privacy Policy, Community Guidelines, and Refund Policy.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to create or use an account. You must provide accurate information and may not create an account for someone else without authorization.

3. Accounts and security

You are responsible for protecting your login credentials and for activity conducted through your account. Notify us promptly at support@popularityoftheworld.com if you believe your account has been accessed without authorization.

You may not sell, transfer, share, or misuse an account. We may require additional verification when necessary to protect users, payments, or the Service.

4. User content

You retain ownership of content you submit. You represent that you own or have permission to use and share that content and that it does not violate the rights of another person.

By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, distribute, format, and make the content available as reasonably necessary to operate, secure, promote, and improve the Service. This license ends when the content is deleted, except where copies must be retained for legal, security, backup, or legitimate operational purposes.

You are responsible for your content. Posting content does not mean that we endorse it.

5. Acceptable use

You must follow our Community Guidelines. You may not use the Service to violate law, infringe intellectual property, threaten or exploit others, distribute malware, manipulate rankings or engagement, commit fraud, evade enforcement, or interfere with the Service.

Automated access, scraping, spam, artificial likes, artificial views, fake accounts, payment abuse, and attempts to bypass security or rate limits are prohibited unless we provide written authorization.

6. Moderation and enforcement

We may review, restrict, remove, preserve, or report content or activity when we reasonably believe it violates these Terms, our policies, applicable law, or presents a risk to users or the Service.

Depending on the circumstances, we may warn users, limit features, suspend monetization, remove content, suspend accounts, or terminate accounts. Available appeals may be submitted through the Service.

7. Memberships and billing

Paid Creator memberships are recurring subscriptions billed through Stripe at the price and interval shown during checkout. Unless canceled, a subscription renews automatically using the payment method on file.

You may manage or cancel a subscription through the billing portal. A cancellation normally takes effect at the end of the current paid billing period. Payments and refund requests are governed by our Refund Policy.

We may change future prices or membership features after giving notice where required. Price changes do not apply retroactively to charges already completed.

8. Gifts and creator earnings

Gifts are voluntary digital purchases supporting an eligible creator. They are not deposits, investments, stored value, charitable donations, or purchases of ownership in Popularity of the World.

Creator eligibility, revenue sharing, and payouts are subject to the requirements displayed in the Service, including membership status, age verification, account standing, performance thresholds, payout onboarding, minimum payout amounts, reversals, refunds, disputes, and applicable fees.

Rankings, views, likes, gifts, eligibility, earnings, and future income are not guaranteed. We may correct errors and exclude fraudulent, self-generated, or manipulated activity.

9. Third-party services

The Service relies on third parties, including Stripe, Supabase, Vercel, and Cloudflare. Your use of their features may also be governed by their terms and policies. We are not responsible for services outside our control.

10. Intellectual property

The Service, excluding user content, is owned by or licensed to Popularity of the World and is protected by applicable intellectual-property laws. These Terms do not grant permission to copy our branding, source code, designs, or other protected materials except as necessary to use the Service normally.

11. Copyright complaints

If you believe content on the Service infringes your copyright or other rights, contact support@popularityoftheworld.com with identification of the work, the disputed material, its location, your contact information, and a good-faith explanation of your claim.

12. Service availability

We may modify, suspend, or discontinue features and may perform maintenance without guaranteeing uninterrupted availability. We do not guarantee that content, rankings, or account data will always be available or error-free.

13. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation. Nothing in these Terms excludes a warranty or right that cannot legally be excluded.

14. Limitation of liability

To the fullest extent permitted by law, Popularity of the World and Seth W. English will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost revenue, lost data, or loss arising from unauthorized access, third-party conduct, or inability to use the Service.

Our total liability arising from the Service will not exceed the greater of $100 or the amount you paid directly to us during the twelve months before the event giving rise to the claim. These limitations do not apply where prohibited by law.

15. Termination

You may stop using the Service at any time. We may suspend or terminate access for violations, fraud, security risks, legal requirements, prolonged inactivity, or discontinuation of the Service. Provisions that logically should survive termination will remain effective.

16. Governing law

These Terms are governed by the laws of the Commonwealth of Kentucky and applicable federal law, without regard to conflict-of-law principles. Any dispute that is not resolved informally will be brought in a court with lawful jurisdiction in Kentucky, unless applicable law requires otherwise.

17. Changes to these terms

We may update these Terms as the Service or law changes. We will post the updated version and revise its effective date. Where required, we will provide additional notice. Continued use after an update becomes effective constitutes acceptance of the revised Terms.
